Key facts

- YellowClose supervision
- How AI is used
- Record that the development control orders that may be given are general orders in accordance with the table to Part 1 of Schedule 5, fire safety orders in accordance with the table to Part 2 of Schedule 5, and brothel closure orders in accordance with the table to Part 3 of Schedule 5. Record that the regulations may amend those tables. Record that a reference in the tables to a planning approval means a development consent, an approval for State significant infrastructure, a certificate under Part 6 other than a compliance certificate, or an approval given under Part 3A when that part was in force or continued in operation. Do not list what an order in a table requires. Do not prepare an order or a response to a notice.
- What the lawyer must review
- The lawyer decides whether an order may be given and what it can require. Section 9.34(1) of the Environmental Planning and Assessment Act 1979 (NSW) says the development control orders that may be given are general orders in accordance with the table to Part 1 of Schedule 5, fire safety orders in accordance with Part 2, and brothel closure orders in accordance with Part 3. Subsection (2) says the regulations may amend those tables. Those regulations, and the tables themselves, were not opened, so the tool does not say what an order requires. Subsection (3) gives planning approval the four meanings set out in the section. The note points to Part 4 of the Building Products (Safety) Act 2017, which was not opened. This task does not prepare an order and does not prepare a response to a notice.
