How AI is used
Summarise only the surveillance and social-media material the lawyer has already placed on the file, with the exhibit or page. Do not collect more material, send a contact request, or state a conclusion about credibility.
What the lawyer must review
  • Do not scrape, send a contact request, or treat the summary as a finding about credibility
  • On a motor accident claim, check Motor Accident Guidelines clauses 4.150 to 4.154
  • Practice Note SC Gen 23 allows a summary of documents and prohibits rephrasing a person's evidence
  • Keep images in a firm-controlled tool (ASCR r 9, APP 11) and decide if a breach is notifiable

The work product

Forum. A New South Wales plaintiff file, including a motor accident claim in which the insurer has served surveillance

Produce. A dated summary of material already on the file, with exhibit or page references and no credibility finding.

Have ready. The surveillance or social-media material already on the file; Whether the claim is a motor accident claim; Any note that a child or a mental health condition appears in the material.

Example of the limit. Illustrative example: The file has an insurer video and a public post the client has already printed. The summary states the date and what is visible, and flags a child in one frame for a check against clause 4.151. It does not say the claim is exaggerated.

Stop and hand it back when

  • The material is not already on the file.
  • The summary would be used as a credibility submission the lawyer has not settled.

Checklist

  1. Use only material already on the file. Do not obtain new images and do not send a social-media request.
  2. For insurer surveillance on a motor accident claim, clause 4.150 prohibits inducement, entrapment or trespass, including a friend request intended to induce, entrap or deceive.
  3. Clause 4.151 treats a person under 18 as a child and limits unnecessary video of children. Clause 4.154 limits surveillance once a mental health condition is known. Clauses 4.152 and 4.153 deal with confidentiality and redaction of uninvolved people.
  4. Practice Note SC Gen 23 paragraph 9B allows a summary of documents. Paragraph 10 prohibits generating the content of a person's evidence. Paragraph 12 prohibits altering or rephrasing that evidence. PIC13 is to the same effect in the Commission.
