Set out the peer-opinion questions for a professional's standard of care
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- From the professional service and the peer opinion the lawyer supplies, build a question table. The lawyer names the civil liability statute. Where that statute is the Civil Liability Act 2002 (NSW), the questions are s 5O. The tool does not decide whether the opinion is widely accepted or irrational, and it does not write the advice.
- What the lawyer must review
- The lawyer decides whether it is established that the professional acted in a manner that was widely accepted in Australia by peer professional opinion as competent professional practice at the time the service was provided, and whether the opinion is irrational, and writes any advice. Other jurisdictions are checked on their own Act. The NSW section is the one opened for this task.
