How AI is used
From the accident facts the lawyer marks, record that a statutory-benefits claim is made on the Nominal Defendant and the 28-day weekly-payment consequence in clause 4.16. Do not decide fault, and do not complete the claim form.
What the lawyer must review
  • Decide whether the other vehicle is unidentified or uninsured, and who must be claimed against.
  • Weekly payments from the day after the accident need a Nominal Defendant claim within 28 days.
  • If the at-fault vehicle is registered outside New South Wales, follow clause 4.39.
  • Keep medical details in the firm's system. Apply ASCR rule 9, APP 11, and the Privacy Act notifiable-breach test.

Checklist

  1. Clause 4.16: where the at-fault vehicle is unidentified or uninsured, the statutory-benefits claim is made on the Nominal Defendant. A claim within 28 days is required for weekly payments from the day after the accident.
  2. Clause 4.39: if the vehicle considered at fault was registered outside New South Wales, the New South Wales insurer managing statutory benefits for the Nominal Defendant gives that insurer a copy of each liability notice, including the notice for benefits after 52 weeks.
  3. Section 6.13 still sets the 3-month claim time and the late-claim test. Clause 4.16 does not replace it.
  4. Do not complete the claim form. Do not decide which vehicle was at fault.
