Check whether a New South Wales child-abuse claim has a pre-court notice

Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the cause the lawyer has named, record whether the lawyer has classed it as a child-abuse claim under Part 1B, a work claim, or a motor-accident claim. Do not invent a pre-court notice for Part 1B.
- What the lawyer must review
- Decide whether any notice statute applies. Part 1B, as opened, does not impose one.
- Confirm the name used for an unincorporated organisation is enough under s 6K.
- Confirm the set-aside forum is the court already hearing the action, citing s 7D.
- Keep the file in the firm's system. ASCR r 9 and APP 11 apply.

The work product
Forum. New South Wales. The court in which the action is brought. There is no separate commission for this claim in the sections opened.
Produce. A note of the notice statute, if any, that the lawyer has selected.
Have ready. The cause the lawyer has named; Whether the organisation is unincorporated; Whether the claim is a work or motor-accident claim.
Example of the limit. Illustrative example: The claim is a Part 1B claim against an unincorporated church and not a work or motor claim. The tool records that the opened sections impose no pre-court notice, and that s 6K is how the proceeding is commenced. The lawyer confirms no other Act applies.
Stop and hand it back when
- The claim is a work or motor-accident claim.
- The tool invents a notice period.

Checklist
- The sections of Parts 1B and 1C that were opened do not impose a pre-court notice of the kind in the Queensland pre-court Act.
- Proceedings against an unincorporated organisation are commenced under s 6K, in the name of the organisation or a name reasonably sufficient to identify it.
- An application to set aside an affected agreement is made in the court in which the action is brought, under s 7D.
- Part 2A, which s 3B describes as special provisions for offenders in custody, was not opened and is not described. A work or motor-accident claim uses that scheme's own notice.

Do not describe a notice requirement from a part of the Act that was not opened.
If this is used in a Supreme Court document, read Practice Note SC Gen 23. The Court's page records amendments that came into effect on 3 February 2025. The note itself was not opened, so no clause is quoted.
