How AI is used
Working from the report the lawyer has selected, list whether it is addressed and signed as the rules require, and quote the words of any code confirmation, with the page. The tool does not rewrite the report.
What the lawyer must review
  • The lawyer decides whether the report can be served or read, and whether leave is needed.
  • Check the code confirmation, the facts relied on, and the opinions against the questions asked.
  • If generative AI was used in the report, apply that court's rule on expert reports.
  • Do not send the report, or the client's records in it, to a public AI tool.

Checklist

  1. Find the code confirmation in the report itself. A letter from the expert's office is not the report.
  2. In New South Wales, stop if the report has no acknowledgement that the expert has read the code and agrees to be bound by it.
  3. In Queensland, check each item in rule 429H, including the confirmation in subrule (4).
  4. Check the service date against the timetable, and whether leave is required for a report served after mediation.
