How AI is used
From the design notes, list each field the chatbot asks for and whether the notes say the tool stores the text. Mark a field the notes describe as information about a client of a lawyer. Write no privacy notice and no risk conclusion.
What the lawyer must review
You write the assessment. Where the chatbot will receive information relating to a lawyer's representation of a client, Model Rule 1.6(a) prohibits the lawyer from revealing that information unless the client gives informed consent, the disclosure is impliedly authorised to carry out the representation, or paragraph (b) permits it. Paragraph (b) was not applied. Rule 1.6(c) requires reasonable efforts to prevent inadvertent or unauthorised disclosure of, or unauthorised access to, that information. ABA Formal Opinion 512 states that the lawyer needs informed consent before inputting client information into a tool that will not keep it confidential. No consumer-privacy statute was opened, so this list does not apply one. If the chatbot will publish a campaign statement or a legislative contact, the operational test in Treasury Regulation § 1.501(c)(3)-1(c) is the exempt-organisation question, and it is separate from Rule 1.6.
