How AI is used
Summarise only the judgment text that was supplied, and list each citation exactly as that text prints it. If the text does not contain a citation, do not add one. Write no sentence of the know-how note.
What the lawyer must review
You write the note that the practice group will use, and you read the judgment. Model Rule 1.1 requires competent representation. ABA Formal Opinion 512 says these tools can hallucinate, that uncritical reliance can breach Rule 1.1, and that citations and analysis must be reviewed before they are used, including before they are given to a court. Model Rule 3.3(a) forbids a lawyer knowingly to make a false statement of fact or law to a tribunal or to fail to correct a false statement of material fact or law the lawyer previously made. A summary that adds a case the supplied text does not contain is not a summary. You check every proposition before the note is circulated.
