Check a know-how note for a citation that was not opened
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List every case, statute, and rule the note cites, and mark each one that has no opened source. Do not invent a reporter citation to fill a gap.
- What the lawyer must review
- Federal Rule of Civil Procedure 11(b)(2) and (3) require that legal contentions presented to a court be warranted by existing law or a nonfrivolous argument, and that factual contentions have evidentiary support, after an inquiry reasonable under the circumstances. A citation the firm cannot open fails that inquiry if the note is later presented to a court. Model Rule 1.1 requires the same care in the know-how note itself. You open each authority or remove it.
