List the closing documents present in a finished matter
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List each closing document by its title and date as the file states them, and mark an item on the firm's closing list that the file does not contain. Write no retention period and no instruction to destroy a document.
- What the lawyer must review
- You decide what is kept and for how long. No file-retention rule was opened, including Model Rule 1.15, so this list does not state a number of years. Model Rule 1.6(a) and (c) govern information relating to the representation: it is not revealed without informed consent, implied authorisation, or a permission in paragraph (b), and the lawyer makes reasonable efforts against inadvertent disclosure or unauthorised access. Paragraph (b) was not applied. ABA Formal Opinion 512 requires consent before that information is indexed by a tool that will not keep it confidential, and independent verification of the index. A missing item is a gap in the file, not a conclusion that the matter failed a legal test.
