Answer an internal how-we-do-this question from the firm's indexed know-how
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Return the indexed passage that answers the question, with its title and location, or state that the index has no passage. Do not answer from outside the index and do not write new practice.
- What the lawyer must review
- You supervise the answer before anyone relies on it. Model Rule 1.1 and Comment 8 require competence, including technology. ABA Formal Opinion 512 says the level of review depends on the tool and the task. Its example is a lawyer who has tested the tool on a smaller set of documents, compared the output with the documents, and found it accurate. That example does not cover an answer that is not in the index. Model Rule 1.6 applies if the question or the passage contains information relating to a representation: do not put that information into a tool that will not keep it confidential without informed consent, as Opinion 512 describes. An internal answer is not advice to a client until you adopt it.
