How AI is used
Compare the draft identification with the client's product note. Flag each draft good or service the note does not use, and quote the note's words for each good the note does use. Write no class number and no identification of your own.
What the lawyer must review
You write the identification. 15 U.S.C. § 1051(a)(1) requires, for a mark used in commerce, the prescribed fee, an application, a verified statement, and the specimens or facsimiles the Director requires. Section 1051(a)(2) requires the application to include, among other items, the goods in connection with which the mark is used, and a drawing of the mark. This comparison only marks a draft good the client's note does not use. Read § 1051(b) before you describe an intent-to-use application. The identification manual is not this section, and you do not assign a class number from it. Section 1052(d) bars a mark which so resembles a mark registered in the Patent and Trademark Office, or a mark or trade name previously used in the United States by another and not abandoned, as to be likely, when used on or in connection with the goods of the applicant, to cause confusion, or to cause mistake, or to deceive. You make that test. The proviso on concurrent registration stays in the statute for you to read.
