- How AI is used
- From the client's product note, list each good or service in the client's words, with the page. Write no identification language and no class number.
- What the lawyer must review
- 15 U.S.C. § 1051(a)(2) requires an application for a mark used in commerce to include, among other items, the goods in connection with which the mark is used, and a drawing of the mark. Section 1051(a)(1) requires the prescribed fee, an application, a verified statement, and the specimens or facsimiles the Director requires. You write the identification. You verify the statement. Section 1052 is where you test whether the mark, as applied to those goods, is registrable, including the likelihood-of-confusion bar in § 1052(d). The client's word list is not the identification.
