- How AI is used
- Record the registration date and whether the file shows a filing in a window section 1058 or section 1059 describes. Leave each window date blank. Write no filing and state no fee.
- What the lawyer must review
- You decide what must still be filed. Section 1058(a) says each registration shall remain in force for 10 years, except that the registration shall be canceled by the Director unless the owner files in the Office affidavits that meet subsection (b), within the one-year period immediately preceding the expiration of 6 years following the date of registration or the date of publication under section 1062(c), and within the one-year period immediately preceding the expiration of 10 years following the date of registration and each successive 10-year period. The owner may file within the six-month grace period immediately following those periods, together with the fee in subsection (b) and the additional grace-period surcharge. Subsection (b) requires either a statement that the mark is in use in commerce, the goods and services on or in connection with which it is in use, such specimens or facsimiles showing current use as the Director may require, and the fee, or a statement of the goods and services on or in connection with which the mark is not in use, a showing that any nonuse is due to special circumstances which excuse the nonuse and is not due to any intention to abandon the mark, and the fee. If a submission filed within the subsection (a) period is deficient, including that it was not filed in the name of the owner, the deficiency may be corrected after the statutory period, within the time prescribed after notification, with the additional deficiency surcharge. Section 1059, subject to section 1058, says each registration may be renewed for periods of 10 years at the end of each successive 10-year period following the date of registration, upon payment of the prescribed fee and the filing of a written application in the form the Director prescribes. The application may be made within one year before the end of each successive 10-year period, or within a grace period of six months after the end of that period, upon payment of a fee and surcharge. You confirm the current fee. The tool calculates no date. The historical notes on the section 1058 page are not the operative periods.
