Key facts

- YellowClose supervision
- How AI is used
- From the policy, extract any words that name a person other than the contracting parties and say the contract is for that person’s benefit. Do not decide that the person can sue.
- What the lawyer must review
- California Civil Code § 1559 says a contract, made expressly for the benefit of a third person, may be enforced by him at any time before the parties thereto rescind it. 15 U.S.C. § 1012(a) leaves regulation of the business of insurance to state law. You decide whether the policy is made expressly for the third person’s benefit and whether the parties have rescinded it. Do not use the Insurance Contracts Act 1984 (Cth) third-party beneficiary test.
