- How AI is used
- Record that nothing in the chapter entitles a person to whom a visa or other documentation has been issued to be admitted, if on arrival the person is found inadmissible under the chapter or any other provision of law. Record that, on an application for admission, a nonimmigrant must present a valid passport and a valid visa unless either or both have been waived, and must establish admissibility or a waiver under section 212(d)(3). Do not decide that the person is admitted. Do not decide that a document has been waived.
- What the lawyer must review
- The lawyer decides admission. 8 U.S.C. § 1201(h) is the nonadmission-on-arrival rule, and it says the substance of that subsection shall appear on every visa application. 8 C.F.R. § 214.1(a) states the passport, visa, admissibility, and inspection conditions for a nonimmigrant applying for admission or an extension of stay. Section 212(d)(3) was not opened, so no waiver is described. The tool does not decide admission.
