How AI is used
Record that a notice to appear must tell the person to provide immediately a written record of an address and telephone number, and to provide immediately a written record of any change. Where the lawyer has marked a case that is before the Board, record that within five working days of a change of address the person must give written notice on Form EOIR-33, and that a representative should also give written notice of a change in the representative's business mailing address. Do not treat five working days as a calculated calendar date. Do not treat this as a duty to correct every answer on a benefit form.
What the lawyer must review
The lawyer decides which address duty applies. 8 U.S.C. § 1229(a)(1)(F) is the notice-to-appear address requirement, including the consequences cross-reference in section 1229a(b)(5), which was not opened. 8 C.F.R. § 1003.38(e) is the five-working-day Form EOIR-33 duty once the matter is before the Board. The tool does not calculate a date and does not describe the in-absentia consequence.
