Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List the three grounds in 8 U.S.C. § 1201(g) and leave each one blank for the application the lawyer has marked: it appears to the consular officer, from the application or the papers, that the person is ineligible under section 1182 or any other provision of law; the application fails to comply with the chapter or the regulations; or the consular officer knows or has reason to believe the person is ineligible under section 1182 or any other provision of law. Record that a benefit request must also establish eligibility at filing and through adjudication. Do not decide that a visa is refused.
- What the lawyer must review
- The lawyer decides whether a ground is met. Section 1201(g) is the nonissuance rule, including two provisos about a bond that are not applied beyond the opened words. Section 1182 was opened for the fraud ground and is not restated as a complete list of inadmissibility. 8 C.F.R. § 103.2(b)(1) is the eligibility rule for a benefit request filed with the agency. The tool does not refuse a visa.
