Record the dental practitioner's division before a peer is chosen
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the registration record the lawyer has selected, record the practitioner's division and the guideline limit that the person practises within that division and only within their education, training and competence. Do not decide which peer field applies, and do not decide breach.
- What the lawyer must review
- The lawyer decides the field for the peer-opinion section. The division is not that decision.
- Continuing professional development does not move a practitioner from one division to another.
- The medication and radiography laws named on the guideline page were not opened.
- Health information stays in a firm-controlled tool, not a public one.

Who does what
| Role | What they do |

| Lawyer | Set the scope, supervise the work closely, verify every part relied on, resolve omissions and exceptions, and approve the exact output. |
Checklist
- The five divisions named on the page are dentist, dental hygienist, dental prosthetist, dental therapist and oral health therapist. The person must practise within the division that applies.
- The person must only perform dental treatment they have been educated and trained in and are competent in. An individual scope may be narrower than the division.
- Continuing professional development does not move a person from one division to another. A dental hygienist, dental prosthetist, dental therapist or oral health therapist does not become a dentist by completing those courses.
- The page says the practitioner should refer when the treatment is beyond their own scope. It also says section 121 of the National Law makes it an offence to carry out a restricted dental act the person is not qualified for, and that sections 113 to 119 deal with title protections. Those sections of the National Law were not opened.
- Do not decide that the field in the peer-opinion section is the same thing as the division. The lawyer decides the field.

These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
Health information stays in a firm-controlled tool. Rule 9.1 of the Legal Profession Uniform Law Australian Solicitors' Conduct Rules 2015, as described by the Victorian Legal Services Board and Commissioner, and APP 11, apply. The lawyer decides whether any loss is notifiable under the Privacy Act 1988 (Cth).
The division table on the page describes a focus for each division. It is not used here as a list of treatments that were or were not negligent.
Laws about possessing, prescribing, supplying and administering medications, and about radiographic procedures, are named on the page and were not opened.
Dental assistants and technicians are not registered. That sentence is not a peer opinion.
