Check whether a non-corporate entity must use a coordinated arrangement

How AI is used
From the entity type and the goods or services, record whether the entity is a non-corporate Commonwealth entity and whether the requirement is one the file says is on a coordinated arrangement. Do not decide that an exemption from the arrangement is available.
What the lawyer must review
The lawyer decides whether the entity must use the arrangement. Paragraph 4.11 describes coordinated procurement as whole-of-Australian-Government arrangements, and says a list is at the Finance procurement pages. That list was not opened, so no arrangement is named from memory. Paragraph 4.12 says non-corporate Commonwealth entities must use coordinated arrangements. An exemption can be granted only jointly by the requesting entity's portfolio minister and the Finance Minister, where the entity can demonstrate a special need for an alternative arrangement. The footnote says an exemption may also follow where the coordinated procurement specifies an alternative approach. Prescribed corporate Commonwealth entities may opt in. The lawyer identifies the arrangement from the Finance list.

Checklist

  1. Do not name an arrangement that is not on the brief. The Finance list was not opened.
  2. A corporate Commonwealth entity may opt in. Do not treat paragraph 4.12 as a must for that entity.
  3. An exemption needs the joint decision the paragraph describes, or the alternative the footnote allows. Do not draft the exemption.
