Check an approach for discrimination on size, ownership, location or origin
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the approach and the conditions, copy any limit that turns on a supplier's size, foreign affiliation or ownership, location, or the origin of the goods or services. Do not decide that the limit is unlawful.
- What the lawyer must review
- The lawyer decides whether paragraph 10.2 is breached. It says that, subject to the Commonwealth Procurement Rules, potential suppliers must not be discriminated against because of their size, degree of foreign affiliation or ownership, location, or the origin of their goods and services. Because the paragraph is subject to the rules, an invitation limit that another paragraph requires is not removed by this one. The lawyer applies those other paragraphs first, then decides whether anything that remains is discrimination of the kind paragraph 10.2 names.
