Prepare the immediate mine-accident notification to MSHA
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- List the time, place and what the incident notes say happened. Do not decide that the event is, or is not, an accident under 30 C.F.R. Part 50, and write nothing that is said to MSHA.
- What the lawyer must review
- 30 C.F.R. § 50.10 requires the operator to contact MSHA at once, without delay and within 15 minutes, at 1-800-746-1553, once the operator knows or should know that an accident has occurred involving a death, an injury with a reasonable potential to cause death, an entrapment with a reasonable potential to cause death, or any other accident. The lawyer, with the operator, decides whether the section applies and makes or approves the call. Open 30 C.F.R. § 50.2 for the definition of accident before treating an event as outside the duty. This is the mine-safety rule, not an offshore blowout notice.
