How AI is used
From the environmental document the lawyer supplies, copy each sentence that states an energy use or a water use, with the page. Do not add a figure and do not conclude that an environmental impact statement is required.
What the lawyer must review
42 U.S.C. 4332(C) requires, consistent with that chapter and except where compliance would be inconsistent with other statutory requirements, a detailed statement by the responsible official in every recommendation or report on proposals for legislation and other major Federal actions significantly affecting the quality of the human environment. The extract copies sentences already in the document. It does not decide that a data-centre or other project is a major Federal action, or that the action significantly affects the quality of the human environment. ABA Formal Opinion 512 (29 July 2024) leaves the lawyer responsible for figures produced with a generative tool. The lawyer decides what, if anything, is said about the approval pathway.
