- From the transfer papers the lawyer supplies, list the lease serial number, the interest described, the date the transferor signed, and whether a bond is mentioned. Do not complete the Bureau of Land Management form and do not file it.
- What the lawyer must review
- 43 C.F.R. § 3106.41 provides that each transfer of record title or of an operating right must be filed with the proper BLM office on a current form approved by the Director, with a separate form for each lease. Section 3106.10 provides that the transferee's rights are not recognized until the authorized officer approves, and that the request for approval must be filed within 90 days from the date the transferor signs and dates the transfer. Section 3106.74 provides that the authorized officer's signature on the official form approves the assignment of record title or the transfer of operating rights, and that the transfer takes effect on the first day of the lease month following the date of filing of all required documents and statements and an appropriate bond if one is required. Section 3106.72 provides that the lessee or sublessee remains responsible for all lease obligations until the date the BLM approves, and remains responsible for obligations that accrued before approval. Section 3106.60 requires the assignee or transferee to furnish a proper bond if bond coverage continues to be required. A transfer of overriding royalty must be filed but, under § 3106.10, does not require approval. The lawyer completes and files the form. The tool does not state the fee in 43 C.F.R. § 3000.120.
