- How AI is used
- From the statements and instruments the lawyer marks, list a transfer above the amount the lawyer sets, a new payee, and a change of who holds a power. Do not say abuse occurred.
- What the lawyer must review
- You decide whether any report or other step is required. 42 U.S.C. § 1397j, for that division, defines abuse as the knowing infliction of physical or psychological harm or the knowing deprivation of goods or services necessary to meet essential needs or to avoid harm, and defines an elder as an individual age 60 or older. It does not set a reporting duty or an undue-influence test. No undue-influence statute was opened. 42 CFR § 483.12 is a facility duty. Use its reporting times only if the person is a resident of a facility that section covers. Formal Opinion 512 applies to the statements.
