Quote any clause that allows a benefit to a third person
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Quote any clause that lets the attorney confer a benefit on a person other than the principal. If there is no such clause, say so. Do not say the benefit is authorized.
- What the lawyer must review
- You decide whether a proposed benefit is within the power. No state statute on benefits to third persons was opened. This check is only the clause. It is distinct from a gift to the attorney. Model Rule 1.4(b) requires an explanation before anyone acts on the quote. Model Rule 1.6 applies if you tell the third person. Formal Opinion 512 requires you to verify the quote. You do not draft a benefit direction.
