- Quote the clause, if any, that says what the attorney may do after learning the power has ended. If there is no such clause, say so. Do not say an act was ineffective.
- What the lawyer must review
- You decide the consequence. No statute on acts done after a power ends was opened. The quote is the instrument's own words. Model Rule 1.4(b) requires an explanation before the attorney relies on it. Model Rule 1.6 applies if you tell a third person that the power ended. Formal Opinion 512 requires you to verify the quote. You do not invent a good-faith protection. None was opened.
