Build a facility elder-abuse reporting checklist from the file
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List the allegation, the time it was formed, whether the notes say it caused serious bodily injury, and which reports are already in the file. Do not name an agency or a phone number.
- What the lawyer must review
- You check the times against 42 CFR § 483.12, and only for a facility that section covers. A covered individual reports a reasonable suspicion of a crime against a resident to the State Agency and to one or more law enforcement entities: immediately, and not later than 2 hours after forming the suspicion if the events cause serious bodily injury, or not later than 24 hours if they do not. The facility's own report of an alleged violation involving abuse, neglect, exploitation, mistreatment, an injury of unknown source, or misappropriation is also immediate, and not later than 2 hours if the events involve abuse or cause serious bodily injury, otherwise not later than 24 hours. Section 1150B of the Social Security Act was not opened. The times above are the words in § 483.12. 42 U.S.C. § 1397j defines abuse, for that division, as the knowing infliction of physical or psychological harm or the knowing deprivation of goods or services necessary to meet essential needs or to avoid harm, and defines an elder as an individual age 60 or older. It does not set these hours. You decide whether a report is due.
