- List the state where the power was signed, if the instrument shows it, and the state of the property in the file. Do not say one state will recognize the power.
- What the lawyer must review
- You decide recognition. No state statute on recognizing an out-of-state power was opened. A model act is not that statute unless you confirm an enactment, and no enactment was opened. Model Rule 1.1 requires you to know the law you apply, including, under Comment 8, the tools you use to find it. Formal Opinion 512 requires independent verification before you rely on a generated answer about recognition. The two states are listed so you can open the right code. The tool does not choose it.
