Record whether the power in the file carries a recording stamp
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Record the date of the power, the state it names, and whether the copy shows a recorder's stamp or a book and page. Do not say recording is required before a dealing.
- What the lawyer must review
- You decide whether this power must be recorded before it is used. No state recording statute for powers of attorney was opened. A missing stamp is not a finding that a dealing would fail, and a stamp is not a finding that the power is effective. Model Rule 1.4(b) is the explanation you give the client. Formal Opinion 512 applies before the power goes into a tool. A uniform act that was not enacted as the law of this state is not cited.
