- Financial powers of attorney and health-care directives are state statutes. The Uniform Law Commission's Power of Attorney Act is a model until the state enacts it. Open that enactment. 42 CFR § 489.102(a) requires specified providers, including hospitals and skilled nursing facilities, to give written information about the individual's rights under state law to make medical decisions and to formulate advance directives. You compare the map with the signed pages. Capacity, revocation and the scope of a gift power are your reading of the state statute.
