Check an overseas student's course progress and attendance
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the attendance record, the assessment record and the sector of the course, list the attendance percentage, any run of more than five consecutive days absent without approval, and whether an intervention or counselling note is on the file. List whether the course is school, ELICOS, foundation, higher education or vocational, and whether the file says an agency has required attendance to be monitored. Do not write a notice of intention to report.
- What the lawyer must review
- The lawyer decides whether progress or attendance is unsatisfactory and writes any notice. The Department of Education Standard 8 factsheet states that a provider monitors course progress and, where the sector requires it, attendance, identifies students at risk and offers support, and extends a confirmation of enrolment only in the circumstances the factsheet states. A school, ELICOS or foundation provider monitors and records both attendance and course progress. The minimum attendance on the factsheet is 80 per cent of scheduled contact hours, or higher if state or territory legislation requires it. A provider may also set a higher figure in its own attendance policy. An intervention strategy identifies, notifies and assists a student absent for more than five consecutive days without approval, or at risk before attendance falls below 80 per cent, and the provider keeps records of that contact and counselling. A higher education provider monitors course progress and is not required to monitor attendance. A vocational provider monitors course progress. It monitors attendance only if the Education Services for Overseas Students agency requires that as a condition of registration, and the factsheet then sets the same 80 per cent minimum. The factsheet describes limited cases where a provider may decide not to report attendance below 80 per cent: for school, ELICOS and foundation, the student is still attending at least 70 per cent and gives genuine evidence of compassionate or compelling circumstances; for a vocational provider required to monitor attendance, the student is still at 70 per cent and is maintaining satisfactory course progress. The factsheet says compliance is measured against the National Code, not the factsheet. This task is the monitoring file. It does not prepare the intention-to-report notice, and it is not the attendance notice for a domestic school student.

Checklist
- Apply attendance monitoring to school, ELICOS and foundation courses, and to a vocational course only where the file shows the agency requires it.
- Flag more than five consecutive days absent without approval, and attendance approaching 80 per cent, and check that an intervention note exists.
- Do not write the intention-to-report notice. That notice, and any decision not to report a student still at 70 per cent, is the lawyer's.
