How AI is used
List each statement in the publication about goods, services or commercial activities, with the page, and a blank for whether it concerns affiliation or a characteristic of the goods. Decide neither issue.
What the lawyer must review
15 U.S.C. § 1125(a)(1) makes liable, in a civil action by a person who believes that he or she is or is likely to be damaged, any person who, on or in connection with any goods or services, or any container for goods, uses in commerce any word, term, name, symbol or device, or any false designation of origin, false or misleading description of fact, or false or misleading representation of fact, which is likely to cause confusion, mistake or deception as to affiliation, connection, association, origin, sponsorship or approval, or which, in commercial advertising or promotion, misrepresents the nature, characteristics, qualities or geographic origin of that person's or another person's goods, services or commercial activities. You decide whether a statement meets either branch. Civil Code § 45 remains the California definition of libel when the claim is defamation rather than § 1125(a).
