- For each item the lawyer marks, record the publication name, the date, the URL or the exhibit number, and the passage. Copy the words. Add no argument.
- What the lawyer must review
- You choose what is tendered. Civil Code § 45 defines libel. Section 48a limits damages for libel in a daily or weekly news publication, or slander by radio broadcast, unless a correction is demanded and not published or broadcast as that section provides, and § 48a(d)(5) defines that kind of publication. You decide whether each item in the bundle is the publication sued on and whether § 48a applies to it. Opinion 512 requires the quote to be checked against the capture.
