- How AI is used
- List each publication and its date, with the page. Leave a blank for any extended date. Write no application and no argument that the one-year period is extended.
- What the lawyer must review
- You decide whether any other statute extends the period, and you write any application. Code of Civil Procedure § 340 opens with the words "Within one year:" and paragraph (c) includes an action for libel or slander. The section as opened states no tolling and no extension. You look up any other statute before you say the year is extended. Civil Code § 45 defines libel as a false and unprivileged publication by writing, printing, picture, effigy, or other fixed representation to the eye, which exposes any person to hatred, contempt, ridicule, or obloquy, or which causes him to be shunned or avoided, or which has a tendency to injure him in his occupation. The date list is not the application.
