Table the prior record against the sentencing factors
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List each conviction or arrest the file states, its date, and the § 3553(a)(1) fact the lawyer assigns. Do not compute criminal-history points.
- What the lawyer must review
- Rule 16(a)(1)(D), upon the defendant's request, requires the government to furnish a copy of the defendant's prior criminal record that is within its possession, custody, or control if the prosecutor knows, or by due diligence could know, that the record exists. You check the table against that production and against the rap sheet in the file. Section 3553(a)(1) is the factor for the history and characteristics of the defendant. Section 3553(a)(4) refers to the guidelines range. The Guidelines Manual was not opened, so the table does not assign points or a range. You decide what the history is worth.
