Leave the non-parole period blank unless a source states one
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List the offense as the charge states it. If a paper in the file states a non-parole period, copy that figure and cite the paper. Otherwise leave the period blank. Do not supply a standard period.
- What the lawyer must review
- You decide the period. Section 3553(a) tells the court to impose a sentence sufficient, but not greater than necessary, and to consider the factors it lists, including the guidelines range. It does not state a standard non-parole period for an offense. The Guidelines Manual was not opened. No statute that sets a standard non-parole percentage was opened. Model Rule 3.3(a)(1) forbids you to tell the court that such a period exists when the opened federal section does not state one. A figure copied from a paper in the file is attributed to that paper. It is not adopted as the law.
