How AI is used
List each place the instructions give and each alibi witness's name, address, and telephone number, and mark what is missing. Do not write the notice and do not say the evidence is an alibi.
What the lawyer must review
You decide whether the evidence is an alibi and you write the notice. Rule 12.1(a)(1) starts with a written request from the government attorney, and that request must state the time, date, and place of the alleged offense. Rule 12.1(a)(2) says the defendant must serve written notice within 14 days after the request, or at some other time the court sets. The notice must state each specific place where the defendant claims to have been at the time of the alleged offense, and the name, address, and telephone number of each alibi witness on whom the defendant intends to rely. This is not a notice measured back from the trial date. No counting rule was opened, so the tool does not name the last day of the 14 days. Rule 12.1(b) is the government's reciprocal disclosure, on its own 14-day timing. Rule 12.1(e) says the court may exclude the testimony of any undisclosed witness regarding the alibi. The rule does not limit the defendant's right to testify. Rule 12.1(f) limits later use of a withdrawn intention. Model Rule 3.3 applies to the notice you serve. This is not a state rule for a trial on indictment.
