List the statute a non-publication draft cites, and whether the source is in the file
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List each statute the draft cites for a non-publication order, and whether that source is in the file. Do not say the statute authorizes the order.
- What the lawyer must review
- You match the order to a statute you have opened. No non-publication or suppression statute was opened, so this check does not supply one and does not say the proposed order is authorized. Model Rule 3.3(a)(1) forbids a knowing false statement of law to the tribunal. Rule 3.3(a)(2) requires disclosure of directly adverse authority in the controlling jurisdiction that is known to you and not disclosed by opposing counsel. Formal Opinion 512 says tool output can have no basis in fact or reality and must be verified. A cite with no source in the file is marked, not repaired.
