How AI is used
List the charge, the court, and any condition an order already in the file imposes. Do not write the defendant's account and do not propose a condition.
What the lawyer must review
You write any factual account. The tool does not outline it. Section 3142 applies when a person charged with an offense appears before a judicial officer. The officer issues an order that, pending trial, the person be released on personal recognizance or an unsecured appearance bond, released on conditions, temporarily detained, or detained. Subsection (c) uses the least restrictive further condition, or combination of conditions, that the officer determines will reasonably assure appearance and the safety of any other person and the community. Subsection (j) says nothing in the section modifies or limits the presumption of innocence. A state bail proceeding is not § 3142. You open the state statute. Model Rule 3.3(a)(1) and (a)(3) govern what you tell the court and what evidence you offer. You do not offer an account you know to be false.
