Check a pre-trial disclosure notice against Rule 16's request rule
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List each item the pre-trial notice says will be disclosed. Do not say the notice completes discovery and do not add an item.
- What the lawyer must review
- You decide what is still missing. Several government disclosures in Rule 16(a)(1) are owed upon the defendant's request. Rule 16(a)(1)(D) is the prior criminal record. Rule 16(a)(1)(E) is documents and objects if one of the three conditions is met. Rule 16(a)(1)(F) begins with results and reports of examinations and scientific tests. You read the rest of (F). Rule 16(a)(1)(G) is the written expert disclosure. A notice that lists items is not itself the defendant's request, and it is not a state statutory list. No state list was opened. Brady remains a due-process duty about favorable evidence. It is not satisfied by the notice. Model Rule 3.3 applies to what you tell the court about the comparison.
