Check a draft sentencing paper against the sources supplied
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- For each case or statute the draft cites, record whether it appears in a source the lawyer supplies, and quote the point that source states. Flag a citation you cannot match. Do not add a case and do not rewrite the paper.
- What the lawyer must review
- You decide what is filed. Model Rule 3.3 is the duty of candor. Formal Opinion 512 warns against a citation you have not checked. Section 3553(a) is the federal sentencing statute. A draft that states a guidelines reduction is not confirmed by this check, because the Guidelines Manual was not opened. A citation that is not in a source you supply stays out of the paper you file.
