- How AI is used
- For each report in the file, list the author, the date, the questions the report says it answers, and the appendices. Do not restate the opinions as the firm’s conclusions.
- What the lawyer must review
- Federal Rule of Evidence 702: a witness qualified by knowledge, skill, experience, training, or education may testify in the form of an opinion if the proponent shows it is more likely than not that the specialized knowledge will help the trier of fact, and the other conditions of the rule are met. The index does not make that showing. Formal Opinion 512 and Rule 1.6: draft reports are confidential, and the lawyer checks the index against the signed report.
