Produce. A payment schedule that identifies the claim, states the scheduled amount, and states the reasons the lawyer has approved, or a note that no schedule will be sent and why.

Have ready. The payment claim and the date it was served; The construction contract’s payment-schedule clause; The respondent’s instructions on the amount and the reasons; The in-force Act, sections 14, 17 and 20.

Example of the limit. A contract that requires the payment schedule within 5 business days expires before the 10-business-day period in section 14(4)(ii). Section 14(4) uses whichever of those times expires earlier.

Stop and hand it back when

  • The schedule is planned as a flat 10 business days because the NSW Government table cites only section 14(4)(ii).
  • A withholding reason is added in the adjudication response after being left out of the payment schedule.
  • The adjudication-response time is taken as either 5 or 2 business days. Section 20(1) uses whichever of those times expires later.

Checklist

  1. Record the date the payment claim was served under section 31 and count business days as defined in section 4. Section 14(4) uses the time the contract requires, or 10 business days after service, whichever expires earlier.
  2. Make the schedule identify the payment claim and indicate the scheduled amount. If that amount is less than the claimed amount, state why, and state each reason for withholding payment.
  3. If the section 14(4) time was missed, use the section 17(2)(b) opportunity only after the claimant’s written notice: 5 business days after the respondent receives that notice. Keep the notice itself inside 20 business days immediately following the due date.
  4. Before any adjudication response is lodged, check section 20. A response is available only if the payment schedule was provided in time under section 14(4) or section 17(2)(b), and it cannot add a withholding reason. Lodge it by the later of 5 business days after receipt of the application and 2 business days after notice of acceptance.
