How AI is used
From the scope of work, list which opened category the work appears to match, and which regime the lawyer names: a Virginia construction contract under § 11-4.6, or a federal public building or public work under § 3131. Record any professional-services exclusion the Virginia definition states. Do not decide that a progress-payment statute applies.
What the lawyer must review
Match the scope to the definition for the regime you name. They are not the same test. Virginia Code § 11-4.6 defines a construction contract as a contract for the construction, alteration, repair, or maintenance of a building, structure, or appurtenance, including moving, demolition, and excavation connected with it, or any provision in a contract relating to the construction of projects other than buildings. The definition excepts contracts awarded solely for professional services as defined in § 2.2-4301. An owner under the section is a person other than a public body. 40 U.S.C. § 3131 is the bond requirement that applies before a contract of more than $100,000 is awarded for the construction, alteration, or repair of any public building or public work of the Federal Government. It is not a definition of construction work for a private progress payment. You decide whether the work is inside the definition you are using.
