Build a residential-construction defect schedule from the inspection
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List each alleged defect, the date of substantial completion if the file prints one, and whether a recorded notice of completion is in the file. Leave the standard and the last day to sue blank. State law governs, and the lawyer confirms the governing state. For example, California.
- What the lawyer must review
- California Civil Code § 896 applies to original construction intended to be sold as an individual dwelling unit. A builder, and to the extent Chapter 4 states, a general contractor, subcontractor, material supplier, product manufacturer, or design professional, is liable for violation of the standards in that section, and the claimant's claims are limited to those violations, except as the title specifically provides. As to condominium conversions, the title does not apply and does not supersede other law. Section 941(a): except as the title specifically sets out, no action may be brought to recover under the title more than 10 years after substantial completion, but not later than the date a valid notice of completion is recorded. Section 941(c) says that limitation may not be asserted by a person in actual possession or control of the improvement when the deficiency is the proximate cause of the claim. You decide which standard is in issue and how the two dates in § 941(a) apply. This is not a home-warranty insurance claim. State law governs, and the lawyer confirms the governing state. For example, California.
