- What the lawyer must review
- The lawyer decides whether the class exemption can be used and completes and sends the notice. The ACCC says the class exemption covers businesses or independent contractors each with turnover under $10 million in the previous financial year, franchisees negotiating with their franchisor regardless of turnover, and fuel retailers negotiating with their fuel wholesaler regardless of turnover. It does not cover collective boycotts. The group must submit the collective bargaining class exemption notice form to exemptions@accc.gov.au or by mail to the Commission. Businesses outside the class use notification or authorisation. Notification is not available to trade unions and is only for transactions below the amounts in the guidelines. Notification does not protect a secondary boycott. Authorisation may.

Checklist
- Check each member's turnover for the previous financial year, unless the member is a franchisee bargaining with its franchisor or a fuel retailer bargaining with its wholesaler.
- If the proposal includes not supplying or not buying unless terms are accepted, stop. The class exemption does not cover a collective boycott.
- Do not treat a secondary boycott as something a notification can protect.
- The lawyer sends the notice. Coverage starts from the process the ACCC page describes, not from a draft.
