Prepare a loss-methodology issues list from sample files
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List, from the sample files, the facts that differ from file to file on how a loss is calculated. Do not choose a methodology.
- What the lawyer must review
- You decide whether the differences are common questions and what method, if any, can be used. Federal Rule of Civil Procedure 23(a)(2) requires questions of law or fact common to the class before members may sue as representatives. A list of differences is not that decision. Formal Opinion 512: check each point against the sample file. Model Rule 1.6: claimant files do not go into a public tool.
