List the release conditions written in the guarantee, and whether a financing statement is to be terminated. Do not write the release.
What the lawyer must review
A guarantee is released on its own terms. You read those terms. If a financing statement is to end, U.C.C. § 9-513 is separate. For consumer goods, the secured party must cause a termination statement to be filed if there is no secured obligation and no commitment to advance or give value, or if the debtor did not authorise the initial filing. The timing is one month after there is no obligation and no commitment, or, if earlier, 20 days after an authenticated demand. For other collateral, the duty to file runs 20 days after an authenticated demand. Article 9 does not discharge a mortgage. Opinion 512: you write the release.
