Map the lender’s enforcement options on a borrower default
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- Index the default clauses, the collateral and the notices already sent. Do not write the enforcement advice or a demand.
- What the lawyer must review
- You write the advice. After default, U.C.C. § 9-610 lets a secured party sell, lease, license or otherwise dispose of collateral, and every aspect of the disposition must be commercially reasonable. The secured party may buy at a public disposition, and at a private disposition only in the cases § 9-610(c) allows. Real-property foreclosure is state law and is not Article 9. Read the security, the credit agreement and the state’s enactment before you tell the client which path is open.
